How to remove the lien from a car you have finished paying

In short

When you finish paying off a financed car, the conditional sale stays recorded until someone cancels it. At CESCO it is cancelled with the vehicle licence and the original certificate of title already carrying the conditional sale cancellation. What is it?

A conditional sale is the lien recorded against the vehicle while you are paying for it: it is what tells the registry a finance company has rights over it. Making the last payment does not erase that entry by itself. Cancellation is the procedure that removes it, and until it happens the vehicle still shows as encumbered, which is exactly what stalls a transfer when a buyer appears.

Who can do it?

It applies to the owner of a vehicle whose conditional sale has been paid off. CESCO sets out two situations and what changes is whether you have the certificate of title: with the original title already carrying the cancellation, the process is direct; without it, you need the finance company’s cancellation letter and must request the duplicate title in the same visit.

Step by step

  1. Step 1: Ask the lender for the letter when you pay off

    The moment to ask is when you make the last payment, not two years later when a buyer appears. The conditional sale cancellation letter is what CESCO accepts when you do not have the title in hand, and getting it later depends on the institution still existing under the same name.

  2. Step 2: Check whether the title already carries the cancellation

    This decides which of the two routes applies to you. If you have the original certificate of title and the conditional sale cancellation appears on it, that plus the vehicle licence is what you take to CESCO. If you do not have it, the other route applies.

  3. Step 3: No title: letter plus duplicate, in the same visit

    CESCO frames it as a single transaction: you bring the finance company’s cancellation letter and request the duplicate certificate of title. It is not two trips if you take everything together.

  4. Step 4: Do it before you need to sell

    A pending lien causes no trouble while the car is yours and stays put. It causes trouble the day there is a buyer in a hurry, because CESCO’s online transfer expressly requires the vehicle to have no liens and to be paid off.

What to do if something goes wrong

If the finance company no longer exists or changed its name, the cancellation letter is the document to chase with whoever took over the portfolio; CESCO does not accept a statement from you in its place. If what is recorded is not a conditional sale but a mortgage lien, CESCO asks for the mortgage centre’s sheet cancelling the mortgage, which is a different document; and if it is an attachment lien, it asks for the interested party’s cancellation authorisation and a $5 code 0827 voucher. If you are selling and the lien is still recorded, the online transfer will not work for you, because it requires the vehicle to be free of liens. CESCO publishes neither cost nor timeframe for cancelling a conditional sale. PRFácil does not process cancellations or deal with finance companies.

Common mistakes

  • Believing the last payment erases the lien from the registry by itself.
  • Not asking for the cancellation letter at payoff and having to chase it years later.
  • Going without the title and without the lender’s letter, which is the only thing that replaces it.
  • Not using the same visit to request the duplicate title.
  • Confusing it with cancelling a mortgage or attachment lien, which ask for different documents.
  • Discovering the pending lien the day a buyer appears.

Frequently asked questions

Does it cancel itself when I finish paying?

No. Cancellation is a procedure done at CESCO with the title already carrying the cancellation, or with the finance company’s cancellation letter if you do not have the title.

I lost the title. What do I do?

CESCO contemplates that case: you bring the finance company’s conditional sale cancellation letter and request the duplicate certificate of title in the same transaction.

Can I sell the car with the lien still on it?

CESCO’s online transfer expressly requires the vehicle to have no liens and to be paid off, so that route is ruled out until you cancel.
